Gay Marriage Opponent Loses Round In Court
A gay marriage opposition group based in Washington is still deciding if it will try and run advertisements in favor of Carl Paladino. This comes after a pre-emptive lawsuit filed by the group was dismissed by a judge who deemed the legal proceeding premature. National Organization for Marriage wants to air the pro-Paladino ads but does not want to be considered a political committee by the state Board of Elections. That classification would require the group to list all of its donors which it does not want to do. So they went to court in an attempt to prevent the Board of Elections from placing that label. However, the judge said the group has not yet been blocked from airing the ads and the Board has not yet labeled the organization a political committee so a lawsuit had no standing. The Board of Elections says if the group wants to air ads in favor of one particular candidate it must abide by the rules of political committees.
